General Terms and Conditions of Sale
The following General Terms and Conditions of Sale govern the offer and sale of products on our Website, www.annaeva.hu.
1.1. The Annaeva Website (www.annaeva.hu) is operated by Annaeva Kft., a limited liability company registered under Hungarian law, having its registered seat at Hungary, 1021 Budapest, Szerb Antal utca 7/B (“Annaeva”). In these General Terms and Conditions of Sale, “we”, “our” and “us” means Annaeva. “You” and “your” means the person placing, or intending to place, an order with us.
1.2. The Website and related services are made available to you in accordance with these General Terms and Conditions of Sale. The act of placing an order on the Website implies that you accept these General Terms and Conditions of Sale fully and without reservation.
1.3. Annaeva reserves the right to change the General Terms and Conditions of Sale at any time. In this event, the applicable General Terms and Conditions of Sale shall be those in force and viewable on the Website on the date when your order is placed.
2.1. On the Annaeva Website, we offer products marked with the “Annaeva” trademark.
2.2. The main characteristics of products (e.g., colour, composition, available size) are shown on each product page. Please note that although the photographs on our Website give as good a representation of each model as possible, they may not exactly correspond to the real garments due to the Internet browser or monitor used.
3.1. Prices of products shown on the Website are in Hungarian forints (HUF). For information purposes only, we may also indicate prices in EUR. In any event, we will charge you in HUF. If you are a customer whose payment card is not denominated in HUF, the final amount charged to your card, which will be determined according to the relevant exchange rates applied by your card issuer, may be different from the prices shown on the Website.
3.2. Prices displayed on the Website include the statutory value added tax.
3.3. Prices of items shown on the Website do not include the cost of delivery. Prices also do not include import duties and taxes. We recommend that you should contact your local customs authority to determine import duties and taxes applicable to your purchase prior to placing an order with us.
4. Making a purchase on the Annaeva Website
4.1. You are eligible to make a purchase on the Annaeva Website if you are age 18 or older.
4.2. To place an order for the purchase of our products, you must fill in an online order form and submit it electronically to Annaeva, following the relevant steps and instructions that you can read on your screen.
4.3. The order form contains information on the main characteristics of the product ordered and its price, the type of payment that you would like to use, your billing address and delivery address, and the shipping costs.
4.4. If you submit the order form to Annaeva, this constitutes an obligation for you to pay the purchase price (including all applicable taxes) and the shipping costs, as indicated on the order form.
4.5. When you submit your order, you unconditionally agree that the provisions of these General Terms and Conditions of Sale will be applicable to your contract with Annaeva. If you do not agree with any of the provisions of these General Terms and Conditions of Sale, please do not submit your order for the purchase of our products.
4.6. Order forms must be submitted in English.
4.7. Once you have submitted your order, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. In these cases, your order will be cancelled and our contract with you will be deemed to have been terminated. If we have already received payment for such order, we will refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, we will contact you to settle the refund.
5.1. Payment of the product prices and relevant costs for shipping and delivery must be made by a payment card with the Mastercard or Visa symbol.
5.2. If the card transaction is approved, the applicable amount will immediately be reserved on your card and you will receive an order confirmation to your email address. Your card will not be debited until the goods are dispatched.
5.3. Annaeva reserves the right to check the validity of your card, its credit status in relation to the order value, and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks. If the card transaction is not approved, your order will be cancelled and our contract with you will be deemed to have been terminated. Please contact your bank or card provider if you have any questions about this.
5.4. We will keep your payment details secure on a best effort basis. However, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.
6. Shipping and delivery
6.1. Annaeva endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. In case of a delivery address in Hungary, we aim to deliver within 3 to 5 working days following confirmation of an order, unless otherwise agreed. Deliveries to other countries normally take 10 to 12 working days. Working days are defined as Monday to Friday and exclude bank holidays. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.
6.2. Before you place your order, you will be informed of the expected delivery details at the checkout stage of your online order. Once you have placed your order, you will receive an email confirmation with your expected delivery date.
6.3. The delivery charge for each order will be the same, regardless of the size or weight of your order.
6.4. We assume that all items purchased are intended for use in the country they were ordered from. If, however, you decide to take the items to another country, you will be solely responsible for adhering to both the exportation legislation of the order country and the importation legislation of the destination country.
6.5. We are not responsible for damage during shipment. From the time they are handed over to the carrier, goods are transported at your risk. If your products are lost or damaged during shipment, you are not entitled to a refund from us. However, in this event Annaeva will take all economically reasonable steps to hold the carrier responsible for any damage caused to the goods purchased by you. To enable Annaeva to do so, you must check the condition of the goods at the time of delivery, and if you notice any missing items or damage, you must make a complaint to the carrier on the spot, immediately at the time of delivery, and also notify us via email. If this is not possible (for example because the damage was not apparent at the time when the carrier handed over the goods to you), you must notify us via email within 24 hours after you have noticed the damage. Annaeva will assess at its sole discretion whether to pursue a claim against the carrier. If a claim is successfully pursued against the carrier, Annaeva will pass on to you any compensation received from the carrier up to the amount paid by you to Annaeva for the damaged or missing goods.
7. Cancellation and returns
7.1. You may cancel your purchase, without any penalty and without specifying the reason, within fourteen (14) days of receiving the products that you purchased from us. You can do this by sending an email to firstname.lastname@example.org in which you clearly state that you wish to cancel your purchase and withdraw from the contract.
7.2. You may exercise your right to cancel your purchase and withdraw from the contract only if you are a person acting outside your trade or profession (i.e., if you are a consumer). You may not withdraw from the contract if you are a company or a business.
7.3. You may not exercise your right to cancel your purchase and withdraw from the contract in respect of products which were manufactured specifically according to your request, or which were tailored specifically to suit you.
7.4. If you have exercised your right to cancel your purchase, you must return the products to Annaeva within fourteen (14) days after you informed us of your decision to withdraw from the contract. You must return the products to Annaeva Kft., Hungary, 1021 Budapest, Szerb Antal utca 7/B. You can use any carrier of your choice to return the goods to us. The cost of return shipping must be borne by you. You will not have to incur any other costs in connection with your return, but you have to reimburse us for any damage caused to the goods, including any damage during transport.
7.5. Your right to cancel your purchase and withdraw from the contract is considered to be lawfully exercised if the following conditions have been satisfied:
(i) you have sent an email to email@example.com, in which you clearly state that you wish to cancel your purchase and withdraw from the contract, within fourteen (14) days from the date of receipt of the products;
(ii) the products must not have been used, worn, perfumed, washed, stained or otherwise damaged – you can try on the clothes only to determine whether they fit you;
(iii) the identification tag must still be attached to the products with the disposable seal;
(iv) the returned products must be dispatched to us within fourteen (14) days after you informed us about your decision to withdraw from the contract.
7.6. If the conditions described in section 7.5 are satisfied, we will refund the purchase price of the products to you. In that case, you will also be refunded an amount equal to the cost of the standard shipping of the purchased products, although you will not be refunded for any additional costs you incurred due to having chosen another kind of shipment and delivery or one that is faster than the standard method. We will refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, we will contact you to settle the refund.
7.7. If the conditions described in section 7.5 are not satisfied, you will not be entitled to a refund. In this case, you may choose to have the products redelivered to you, at your expense, and in the condition in which they were returned to us. Otherwise, we may retain the products with no obligation to provide you with a refund.
7.8. You are not permitted to exchange or to replace purchased products with other products.
8. General warranty, product warranty
8.1. If your product is defective, you may exercise your general warranty rights (in Hungarian: “kellékszavatosság”) stipulated in 6:159-167. § of the Hungarian Civil Code (Act V of 2013). For the purposes of these rules, the product is considered to be defective if it does not meet the quality requirements laid down in legislation or agreed in our contract. According to these provisions, you may request that we shall repair or replace the defective product, except if this is impossible or if it would be unreasonably expensive. In this case, or if you do not wish to have the product repaired or replaced by us, you may have the product repaired by yourself or by a third party, you may request a price reduction, or you may withdraw from the contract (except that you may not withdraw from the contract because of a minor defect). If you recognize any defects, you must notify us about your wish to exercise your general warranty rights without delay, but in any event no later than within two months after recognizing the defect. If you are a person acting outside your trade or profession (i.e., if you are a consumer), and if you notify us about the defect within six months after delivery, it is assumed that the product was defective at the time of delivery, unless such assumption would contradict the nature of the defect. Otherwise, you must prove that the product was defective at the time of delivery. General warranty rights are exercisable for two years after delivery.
8.2. If your product is defective, and if you are a person acting outside your trade or profession (i.e., if you are a consumer), you may also exercise your product warranty rights (in Hungarian: “termékszavatosság”) stipulated in 6:168-170. § of the Hungarian Civil Code (Act V of 2013). For the purposes of these rules, the product is considered to be defective if it does not meet the general quality requirements in force at the time of your purchase, or if it does not meet the specifications provided by Annaeva. According to these provisions, you may request that we shall repair or replace the defective product. If you wish to exercise your product warranty rights, you must prove that the product was defective when it was delivered to you. If you recognize any defects, you must notify us about your wish to exercise your product warranty rights without delay, but in any event no later than within two months after recognizing the defect. Product warranty rights are exercisable for two years after delivery.
8.3. You may exercise either your general warranty rights or product warranty rights, but not both.
10. Governing law
10.1. These General Terms and Conditions of Sale are governed by Hungarian law, in particular by the Act V of 2013 on the Civil Code, and – if you are a consumer – Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses.

10.3. The United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980) is excluded.
